Canna World Market Publishes Free Plain-Language Guide to the Section 781 Hemp THC Rule

Garden City, United States - November 5, 2026 / Canna World Market /

Canna World Market, a comparison site for CBD, hemp, functional mushroom and botanical products, has published a plain-language guide to the federal change in the definition of hemp that takes effect on December 11, 2026. The guide, "What's changing on December 11," covers what the rule says, which products it reaches, what is not affected, and how state rules can differ. It is a summary and not legal advice.

What the rule says

The change is in Section 781 of Public Law 119-37. Two parts matter to a shopper. First, total THC is what counts. The limit covers total THC, which includes THCA, the form found in raw hemp flower, and not only delta-9 THC. Second, the limit is per container. A finished hemp-derived cannabinoid product may hold no more than 0.4 mg per container of total THC combined with any other cannabinoids that have similar effects to THC, as the Secretary of Health and Human Services determines. The law defines a container as the innermost wrapping, packaging or vessel that holds the product for retail sale, such as a jar, bottle, bag, box, packet, can, carton or cartridge. The limit covers the whole container, not one serving. A bottle of 30 servings with 1 mg of THC in each holds 30 mg, well over the limit.

When it takes effect

A continuing resolution, H.R. 6500, signed on September 2, 2026, moved the start of most of the rule from November 12 to December 11, 2026. Until then the new definition applies only to synthetic cannabinoids, the ones the hemp plant does not make on its own, so those are restricted from November 12. As of November 3, 2026, the FDA had not published the lists of cannabinoids the law directs it to publish, or the additional detail on the term container that the law also calls for.

What stays available

The limit does not apply to products with no THC. The guide lists THC-free CBD, including broad spectrum and isolate products, functional mushroom products such as lion's mane, THC-free topicals such as balms, creams and salves, and products made without hemp.

State rules can differ

States set their own hemp rules, and some may restrict hemp THC products sooner or differently. The guide advises readers to check the rules in their own state.
