Com+ Mechanical, a commercial HVAC contractor based in Midtown Manhattan, has published a free 2026 reference index that places building performance standard penalties side by side with typical HVAC retrofit cost ranges across six U.S. jurisdictions. The index is intended to give building owners and property managers a structured basis for comparing the recurring cost of non-compliance against the one-time investment of a mechanical upgrade.
Penalty Rates Across Six Jurisdictions
The index documents penalty structures that vary considerably by city and methodology. New York City's Local Law 97 carries a penalty of $268 per metric ton of CO2e over a building's emissions limit, assessed every year the building remains over its limit. Boston's BERDO regulation sets its rate at $234 per metric ton, while Maryland's framework starts at $230 per metric ton in 2020 dollars and increases by $4 per ton annually.
Other jurisdictions use a different unit of measure. Denver assesses $0.30 per kBtu over a building's energy target. Washington DC can impose penalties of up to $10 per square foot per compliance cycle, capped at $7.5 million. Seattle applies $10 per square foot for non-residential properties per five-year cycle. Because each program sets its own schedule, measurement methodology, and escalation provisions, the index notes that owners should confirm current rates directly with the relevant jurisdiction before making financial decisions.
Retrofit Costs Placed in Context
To give the penalty figures practical meaning, the index pairs them with typical planning cost ranges drawn from published research. Controls and building automation system upgrades typically fall in the range of $2.50 to $7.50 per square foot. Heat-pump electrification projects, which move heating off fossil fuel, carry a wider range of roughly $12 to $24 per square foot, based on an RMI analysis of a NYSERDA study. These are planning figures, not quotes; actual cost depends on the building.
A central point the index makes is structural: building performance standard penalties recur every year a property misses its target, while a retrofit is generally a one-time capital cost. For owners weighing whether to act now or wait, that difference is the core of the capital-planning math.
Why the Index Was Published
Limits under several of these programs tighten on a set schedule, so a building that meets today's threshold can fall out of compliance at the next interval. For many owners, commercial HVAC compliance in NYC and other cities with building performance standards has become a budgeting question as much as an engineering one.
